Terms of Service

These terms govern Kingdom Metrics' Attendance Capture service and form the agreement between Kingdom Metrics and the client church (the "Agreement").

1. What We Provide

Kingdom Metrics will provide Attendance Capture Services for Client, using our system to count attendance at your services. This includes:

  • AI counting of attendance during services, from still images.
  • Secure data processing to generate attendance reports.
  • Emailed reports with attendance insights.

Attendance Accuracy Disclaimer

  • Kingdom Metrics provides attendance counts using AI counting (computer vision) on still images, which is designed to be more accurate and consistent than manual counting methods. We count people; we do not recognize, identify, or follow individuals from one service to the next.
  • Differences between Kingdom Metrics' numbers and prior attendance tracking may occur due to variations in past counting methods, and should be considered as part of the transition to a more precise attendance measurement system.

Warmup & Accuracy Calibration Period

  • Kingdom Metrics' Attendance Capture system requires a 2-week warmup period to calibrate attendance counting for Client.
  • During this period, there may be higher variability in accuracy and slightly longer reporting times as the system refines its ability to count attendance accurately.
  • After the warmup period, attendance reporting will be fully automated and optimized for accuracy.

Additional Campuses

If Client wants to add another campus to Attendance Capture, Kingdom Metrics will provide service for the new location at the agreed-upon rate per location. Any additional campuses will be billed separately or added to the existing invoice.

2. Your Commitment

To ensure smooth operation, you agree to:

  • Install the necessary cameras in your building (or allow us to do so).
  • Provide access to service schedules so we can count attendance at the right times.
  • Keep your billing information updated for continued service.

Client Responsibilities

Client is responsible for ensuring that cameras remain unobstructed, powered, and connected to the network at all times. Please tell us before, or as soon as possible after, changes such as:

  • A new WiFi network name or password
  • A new router, internet provider, or network setup
  • Moving, unplugging, or re-aiming a camera
  • Electrical work that cuts power to a camera

Most missed counts we see trace back to a change like these that we were not told about.

3. Pricing & Payment

  • The cost for Attendance Capture is billed monthly at the rate displayed at checkout.
  • Monthly billing begins 40 days after purchase or 10 days after delivery of hardware to Client, whichever comes first.
  • Monthly billing will be charged automatically to the payment method on file until canceled.
  • If payment fails, we will notify you and allow a 15-day grace period before pausing service.

Installation & Equipment Costs

  • A one-time hardware fee as displayed at checkout applies per unit, which includes one camera and software setup.
  • If additional costs are required (e.g., extra cameras, travel for installation), Kingdom Metrics will provide a quote before installation.
  • The camera becomes the property of Client after purchase. If the subscription is canceled, the Client retains the camera, but Kingdom Metrics will no longer provide attendance counting services.

Hardware Returns

Client may return the camera within 30 days of delivery for a full refund of the hardware fee. Kingdom Metrics provides a prepaid return shipping label at no cost to Client. To initiate a return, contact hello@kingdommetrics.com with the order details. The camera must be returned in working condition; refunds are issued to the original payment method within 10 business days of receipt. This return window applies to the one-time hardware fee only and does not include subscription charges, which are governed by the cancellation terms below.

Price Adjustments

Kingdom Metrics may adjust pricing with a 45-day notice. Any price updates will be communicated via email and will take effect on the next billing cycle after the notice period. If you do not agree to the new pricing, you may cancel your service before the new rates take effect.

Historical Data Integration

To enhance attendance reporting in the first year, Kingdom Metrics will import and analyze prior attendance data from Client's database as part of the service. After the first year, Kingdom Metrics' attendance measurement will provide year-over-year comparisons without the need for historical data imports.

4. Marketing & Branding Usage

By signing up for Kingdom Metrics' Attendance Capture, Client grants Kingdom Metrics permission to use the Client's name and logo on our website and promotional materials to indicate that you are a Kingdom Metrics client. If you prefer to opt out of this, simply email us at hello@kingdommetrics.com at any time.

5. Privacy & Data Protection

  • Attendance data is used to provide your reports and, as described in our Privacy Policy, to improve the service. It is never sold.
  • All data is processed securely in accordance with our Privacy Policy.
  • We do not identify individuals in attendance: no facial recognition, no identity profiling, no tracking of people between services. Images are used to produce aggregate counts and are handled as personal data under our Privacy Policy and Data Processing Agreement.
  • Where we process personal data on your behalf, our Data Processing Agreement forms part of these terms.

Service Availability & Technical Issues

  • Kingdom Metrics aims to provide accurate attendance counting with minimal interruptions. However, service availability may be impacted by onsite factors beyond our control, including internet outages, power failures, or physical obstructions to cameras.
  • If a technical issue prevents attendance counting for a service, Kingdom Metrics will make reasonable efforts to assist in diagnosing the issue and restoring service. However, Kingdom Metrics is not responsible for outages caused by onsite conditions.
  • In the event of a system-related failure on Kingdom Metrics' end, we will work promptly to restore functionality. Attendance reports may be unavailable for affected services, but no refunds or credits will be issued for temporary disruptions.

Data Security

Kingdom Metrics is committed to maintaining the confidentiality and security of all collected attendance data. Data is processed securely; we never attempt to identify individuals, and we never sell attendance data. Service providers that process data on our behalf are bound by confidentiality and data-protection obligations, as described in our Privacy Policy.

6. Ending the Service

Client may cancel at any time by providing at least 14 days' notice before the next billing date. Service will continue until the end of the paid period, and no partial-month refunds will be issued after a billing cycle has started.

Kingdom Metrics may suspend or terminate service at any time with reasonable notice. In cases of non-payment, misuse of the service, or behavior that disrupts operations, service may be paused or terminated immediately.

7. Limitation of Liability

Kingdom Metrics shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Attendance Capture service. In no event shall Kingdom Metrics' total liability exceed the amount paid by Client for services in the previous 2 months, except that for claims arising from Kingdom Metrics' breach of the Data Processing Agreement or of applicable data-protection law, Kingdom Metrics' total liability is limited to the fees paid by Client in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

8. Dispute Resolution

Any disputes arising from this agreement will be resolved through mediation. If mediation is unsuccessful, the parties agree to submit to binding arbitration in Palm Beach County, Florida in accordance with Florida law. Each party will bear its own costs for dispute resolution. For customers in the United Kingdom, the Data Processing Agreement is governed by the laws of England and Wales, as stated in that agreement.

By moving forward with Kingdom Metrics' Attendance Capture, Client agrees to these terms.
